Nacional Popular decreta, nos termos do n.\u00ba 6 do artigo 56.\u00ba da Constitui\u00e7\u00e3o, o seguinte:</p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">CAP\u00cdTULO I</p><h1 align=\"center\" style=\"text-align: center;\"><strong>DISPOSI\u00c7\u00d5ES GERAIS</strong></h1><p align=\"center\" style=\"text-align: center;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 1.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Objectivo)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">\u00a0A presente lei regula as mat\u00e9rias relativas\u00a0\u00e0 observa\u00e7\u00e3o internacional. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 2.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Defini\u00e7\u00f5es)</b></p><p align=\"center\" style=\"text-align: center;\"></p><p class=\"MsoBodyText\">Entende-se por observa\u00e7\u00e3o internacional a verifica\u00e7\u00e3o da regularidade das v\u00e1rias fases do processo eleitoral nomeadamente o recenseamento eleitoral, a organiza\u00e7\u00e3o e a pr\u00e1tica dos actos de vota\u00e7\u00e3o e o apuramento e validade do escrut\u00ednio pelos observadores internacionais. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 3.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(In\u00edcio e termo da observa\u00e7\u00e3o internacional)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">A observa\u00e7\u00e3o internacional inicia-se com o recenseamento eleitoral e termina 30 dias ap\u00f3s a investidura do Presidente da Rep\u00fablica e dos Deputados da Assembleia Nacional Popular. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 4.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Incompatibilidade)</b></p><p align=\"center\" style=\"text-align: center;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">\u00c9 proibido exercer as fun\u00e7\u00f5es de observador internacional:</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Aos cidad\u00e3os guineenses, ainda que tenham adquirido nacionalidade de estrangeiro;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Aos diplomatas\u00a0no activo no pa\u00eds ou aqueles que tenham exercido essa fun\u00e7\u00e3o no pa\u00eds, bem como aos seus c\u00f4njugues.</p><p style=\"text-align: justify;\">\u00a0\u00a0</p><p align=\"center\" style=\"text-align: center;\">CAP\u00cdTULO II</p><h2 align=\"center\" style=\"text-align: center;\"><strong>OBERVADORES INTERNACIONAIS</strong></h2><p align=\"center\" style=\"text-align: center;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 5.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Entidades internacionais)</b></p><p align=\"center\" style=\"text-align: center;\">\u00a0</p><p style=\"text-align: justify;\">1.\u00a0\u00a0\u00a0\u00a0\u00a0 S\u00e3o considerados observadores internacionais os representantes das seguintes organiza\u00e7\u00f5es:</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0 A Organiza\u00e7\u00e3o da Uni\u00e3o Africana;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0 A Organiza\u00e7\u00e3o das Na\u00e7\u00f5es Unidas;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">c)\u00a0\u00a0\u00a0\u00a0 A Organiza\u00e7\u00e3o da Uni\u00e3o Europeia.</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">2.\u00a0\u00a0\u00a0\u00a0\u00a0 Podem igualmente ser investidos na qualidade de observadores internacionais personalidades estrangeiras convidadas nos termos do artigo 8.\u00ba do presente diploma.\u00a0 </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 6.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Compet\u00eancia)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">1.\u00a0\u00a0\u00a0\u00a0\u00a0 Compete aos observadores internacionais verificar e fiscalizar:</p><p class=\"MsoBodyText\">\u00a0</p><p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0 O processo do recenseamento eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0 A implanta\u00e7\u00e3o e o funcionamento da Comiss\u00e3o Nacional de Elei\u00e7\u00f5es e das Comiss\u00f5es Regionais de Elei\u00e7\u00f5es;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">c)\u00a0\u00a0\u00a0\u00a0 A legalidade e a imparcialidade nas decis\u00f5es das inst\u00e2ncias judiciais relativas ao contencioso eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">d)\u00a0\u00a0\u00a0\u00a0 A isen\u00e7\u00e3o da Comiss\u00e3o Nacional de Elei\u00e7\u00f5es e das Comiss\u00f5es Regionais de Elei\u00e7\u00f5es;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">e)\u00a0\u00a0\u00a0\u00a0 A conformidade legal das candidaturas;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A isen\u00e7\u00e3o dos \u00f3rg\u00e3os de comunica\u00e7\u00e3o social do Estado, durante a campanha e apuramento dos votos;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">g)\u00a0\u00a0\u00a0\u00a0 O cumprimento das normas de vota\u00e7\u00e3o adoptadas;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">h)\u00a0\u00a0\u00a0\u00a0 O acesso nacional aos \u00f3rg\u00e3os de comunica\u00e7\u00e3o social do Estado pelos Partidos, Coliga\u00e7\u00f5es de Partidos ou candidatos a Presidente da Rep\u00fablica;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">i)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A circula\u00e7\u00e3o de pessoas nas fronteiras.</p><p style=\"text-align: justify;\">\u00a0</p><ol type=\"1\" start=\"2\"><li style=\"text-align: justify;\">Compete ainda aos observadores internacionais:</li></ol><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0 Comunicar\u00a0\u00e0 CNE todas as irregularidades de que tenham conhecimento;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0 Emitir os relat\u00f3rios necess\u00e1rios durante e ap\u00f3s a campanha eleitoral. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 7.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Dever de colabora\u00e7\u00e3o)</b></p><p align=\"center\" style=\"text-align: center;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Os \u00f3rg\u00e3os centrais e locais do Estado, bem como a CNE e as CRE devem proceder de modo a proporcionar aos observadores internacionais as garantias e facilidades que lhes permitam cumprir cabalmente a sua miss\u00e3o.\u00a0 </p><p class=\"MsoBodyText\">\u00a0</p><p style=\"text-align: justify;\">2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Os \u00f3rg\u00e3os de Estado devem garantir e zelar pela seguran\u00e7a e integridade dos observadores internacionais. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">CAP\u00cdTULO III</p><h1 align=\"center\" style=\"text-align: center;\"><strong>CONVITE AOS OBSERVADORES</strong></h1><h1 align=\"center\" style=\"text-align: center;\"><strong>INTERNACIONAIS</strong></h1><p align=\"center\" style=\"text-align: center;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 8.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Compet\u00eancia)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">Compete\u00a0\u00e0 CNE por iniciativa pr\u00f3pria ou sob proposta do Presidente do Conselho de Estado, dos Partidos Pol\u00edticos ou Coliga\u00e7\u00f5es de Partidos, convidar os observadores internacionais.</p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 9.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Procedimento)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">1.\u00a0\u00a0\u00a0\u00a0\u00a0 A entidade que pretende convidar observadores internacionais, nos termos no artigo anterior, deve endere\u00e7ar o seu pedido\u00a0\u00e0 CNE que o formaliza. </p><p class=\"MsoBodyText\">\u00a0</p><p style=\"text-align: justify;\">2.\u00a0\u00a0\u00a0\u00a0\u00a0 Na formaliza\u00e7\u00e3o dos convites propostos pelos partidos Pol\u00edticos, Coliga\u00e7\u00f5es de Partidos ou candidatos a Presidente da Rep\u00fablica, a CNE dever\u00e1 respeitar o princ\u00edpio da paridade. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 10.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Defini\u00e7\u00e3o do n\u00famero de observadores)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">A CNE deve definir o n\u00famero m\u00e1ximo de observadores internacionais. </p><p align=\"center\" style=\"text-align: center;\">ARTIGO 11.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Identifica\u00e7\u00e3o)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A CNE deve identificar e credenciar devidamente todos os observadores internacionais.</p><p class=\"MsoBodyTextIndent\">\u00a0</p><p style=\"text-align: justify;\">2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A identifica\u00e7\u00e3o ser\u00e1 feita mediante um cart\u00e3o de identidade e um distintivo comum. </p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00c9 obrigat\u00f3rio o uso de distintivo pelo observador internacional durante o per\u00edodo de exerc\u00edcio das suas fun\u00e7\u00f5es. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">CAP\u00cdTULO IV</p><h2 align=\"center\" style=\"text-align: center;\"><strong>DOS DIREITOS E DEVERES</strong></h2><p align=\"center\" style=\"text-align: center;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 12.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Direitos)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">Constituem direitos dos observadores internacionais:</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0\u00a0 Obten\u00e7\u00e3o do \"visto\" de entrada na Guin\u00e9-Bissau, ainda que nos postos fronteiri\u00e7os;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0\u00a0 Liberdade de circula\u00e7\u00e3o no territ\u00f3rio nacional;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">c)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Contactar qualquer entidade governamental e institui\u00e7\u00f5es envolvidas no processo eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">d)\u00a0\u00a0\u00a0\u00a0\u00a0 Obter esclarecimentos necess\u00e1rios relativos a legisla\u00e7\u00e3o eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">e)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Liberdade de contactar os Partidos Pol\u00edticos, Coliga\u00e7\u00e3o de Partidos e candidatos\u00a0\u00e0 Presid\u00eancia da Rep\u00fablica, bem como qualquer cidad\u00e3o;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Acompanhar o processo de recenseamento eleitoral dos actos de campanha eleitoral, a vota\u00e7\u00e3o e o respectivo apuramento;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">g)\u00a0\u00a0\u00a0\u00a0\u00a0 Acesso a toda a documenta\u00e7\u00e3o relativa ao processo eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">h)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Obter a colabora\u00e7\u00e3o da CNE e das CRE;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">i)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Tomar conhecimento de todas as den\u00fancias, queixas ou reclama\u00e7\u00f5es durante e ap\u00f3s o acto eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">j)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Verificar a conformidade de participa\u00e7\u00e3o dos Partidos Pol\u00edticos e Coliga\u00e7\u00f5es de Partidos nas estruturas ligadas ao processo eleitoral, em conformidade com a lei;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">l)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Estruturar a sua forma de interven\u00e7\u00e3o a n\u00edvel central e regional;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">m)\u00a0 \u00a0Prestar declara\u00e7\u00f5es que julgar convenientes aos \u00f3rg\u00e3os de\u00a0\u00a0 comunica\u00e7\u00e3o social, desde que n\u00e3o ponham em causa o normal funcionamento do processo eleitoral;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">n)\u00a0\u00a0\u00a0\u00a0 Permanecer nas assembleias de voto. </p><p style=\"text-align: justify;\">\u00a0\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 13.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Deveres)</b></p><p class=\"MsoBodyText\"><b>\u00a0</b></p><p class=\"MsoBodyText\">\u00a01.\u00a0 Constituem deveres dos observadores internacionais: </p><p class=\"MsoBodyText\">\u00a0</p><p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0\u00a0 Agir em conformidade com a Constitui\u00e7\u00e3o da Rep\u00fablica e demais leis em vigor;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0\u00a0 Agir com independ\u00eancia, transpar\u00eancia e imparcialidade;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">c)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Elaborar relat\u00f3rios de actividade e remet\u00ea-los\u00a0\u00e0 CNE.;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">d)\u00a0\u00a0\u00a0\u00a0\u00a0 Identificar-se perante a CNE e as CRE\u2019s ou quando solicitado por entidade competente;</p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">e)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Comunicar por escrito\u00a0\u00e0 CNE qualquer irregularidade, queixa ou reclama\u00e7\u00e3o que tenham conhecimento. </p><p style=\"text-align: justify;\">\u00a0</p><p style=\"text-align: justify;\">3.\u00a0\u00a0\u00a0\u00a0\u00a0 A CNE pode anular o Estatuto e fazer cessar a actividade do observador internacional que viole os deveres estabelecidos no n\u00famero anterior. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 14.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Regulamenta\u00e7\u00e3o)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">Em caso de necessidade, compete\u00a0\u00e0 CNE regulamentar a presente lei.</p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 15.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(Vig\u00eancia da lei)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">A presente lei entra em vigor para as primeiras elei\u00e7\u00f5es multipartid\u00e1rias. </p><p style=\"text-align: justify;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">\u00a0</p><p align=\"center\" style=\"text-align: center;\">ARTIGO 16.\u00ba</p><p align=\"center\" style=\"text-align: center;\"><b>(D\u00favidas e Omiss\u00f5es)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">As d\u00favidas e omiss\u00f5es resultantes da interpreta\u00e7\u00e3o e aplica\u00e7\u00e3o da presente lei ser\u00e3o resolvidas pela CNE.\u00a0 </p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p align=\"center\" style=\"text-align: center;\">ARTIGO 17.\u00ba</p><p align=\"center\" style=\"text-align: center;\">(<b>Entrada em vigor)</b></p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyTextIndent\">Esta lei entra em vigor imediatamente ap\u00f3s a sua publica\u00e7\u00e3o. </p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">Aprovado em 5 de Mar\u00e7o de 1994. </p><p style=\"text-align: justify;\"><b>\u00a0</b></p><p class=\"MsoBodyText\">Publique-se.</p><p
